My friend used AC21. He switched jobs after 6 months of filing for 485. He had a query on his 485 seeking experience letters for previous and current employment. He filed those and his 485 approved.
As the title suggest, it is meant for folks who have invoked AC21 (1-140 approved, I-485 filed & pending more than 6 months, job desc almost similar) successfully and unsuccessfully.
If you have successfully transferred, can you comment on the experience, any denial notices that you had to overcome? Have you got the green card finally?
If unsuccessful, what issues are you facing? Is there some work around or going back to desh is the only option?

I got RFE on my whole family’s pending I-485 applications
The REF description is “ There is a missing signature in page 4 of your application. The signature of the person who prepared your form I-485 is missing. Please have it signed by the preparer, Mr. ABC”.
I used software owned by company(Ex) to prepare these forms. And Mr. ABC is heads for immigration department in that company. I entered all the necessary info in that application and took print out for 485 form. Mr ABC details and company address printed in the 4th page of I-485 application(Part 5.Signature of person preparing form, if other than above.(sign below)) area.
Mr ABC did not put the signature there because he did not prepare the application and sent application to USCIS. My signature is there in applicant area(no problem).
We got RFE for missing preparer signature.
Now,
I contacted ex-company to get the signature on my I-485 application but he no longer working with them. Company immigration people are telling me that the signature in not required in that form.
I contacted Mr ABC for signature but I am not sure his signature is valid now on my I485 application.(because he is no longer working with them)
Finally I think the "prepared by signature" is not at all required because I entered all my information for my I-485.

How will USCIS process the I-485 petitions?. According to the applicant's labor priority date or I-485 petition receipt date?. pray tell....:confused:

Hello All,
My priority date becomes current as of 1'st Oct 2009... I had created an Service Request 2 weeks back to check with NSC if it has been preadjudicated or not...
Here is what i received as an email response to the Service Request today-
The status of this service request is:
The processing of your case has been delayed. A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact us by calling our customer service number provided below.
Questions:
1. What am i supposed to do now?
2. I remember seeing a Memo back in Feb 2008 which stated that 485 can be approved after waiting for 6 months for background check and not more than that.
Please let me know if anyone else has received a similar reply in Sep 2009... Any thoughts are highly appreciated...

I am working on EAD, if it doesnt come in time any ideas about the FAX # which you need to send your request? I have already opened an expedite request for my EAD by calling USCIS customer service, I just need the fax # and the cover letter format. I heard that even if you take an info pass appointment, they dont issue an interim EAD , is that correct?

Hi,
I got laidoff recently. My company is going to withdraw H1b. I have my 140 approved from same company and my 485 pending. I have EAD and never used and working on H1B for the same company. I was working for the same company which processed my H1B.
If H1B is withdrawn is there going to be any effect on my 485? like any possibility of RFE on 485 for EVL? My employer said they will not withdraw or revoke 140.
How long will it take to withdraw H1B?

I got FP notice inside 2 weeks of submitting my EAD application. I am in TSC. Again FP depends on when you last Finger prints. I dont everyone 'HAS' to get FP.

No I haven't filed a tax return before, because there was no need. I started studying in August 2008 and remained most of 2009 in the US.
2 points:
1. So therefore I guess I'm a nonresident for 2009 (because I wasn't a lot in the US in 2008).
But I'm a resident for 2010 (because I was in the US almost all of 2009). With 2010 I mean the tax filling I'll have to do next year.
Am I correct with this reasoning? Does the substantial presence test only count for the next year?
2. Is it correct, that they took 25% of my sign up bonus away? I was an F-1 all of 2009.

Attorney Eugenia Ponce recently wrote a blog post here (http://www.immigration-law-answers-blog.com/2009/07/immigration-law/immigration-rights/lawful-permanent-residents-keep-trips-abroad-relatively-short/) cautioning Lawful Permanent Residents to keep their trips abroad relatively short. Here is the text of that post:
Lawful permanent residents (LPR) of the United States (green card holders) need to keep their trips abroad to a relatively short period of time. The Department of Homeland Security (DHS) could determine that an LPR has abandoned their residence if the LPR’s intent was not to return to the U.S. within a relatively short period of time.
Factors DHS could consider in evaluating the LPR’s intent include:
Whether the trip abroad is lengthy or for a short period of time;
LPR’s family ties in the U.S.;
property holding in the U.S.;
business affiliations within the U.S.;
LPR’s family, property, and business ties in the foreign country.
After that was posted, we were asked what exactly we meant by the term "relatively short." Of course the answer, as always, depends on several factors. But here is a further explanation from Ms. Ponce:
What a "relatively short period of time" is can't be defined in terms of elapsed time alone. Yesterday I e-filed my EAD and AP renewal for me and my wife but I think I may have messed up a little.
1) I forgot to save the confirmation receipt( pdf) from me and now I cannot get it anywhere. I did it save it for my wife. I belive I need this along with the supporting documents. How Can I request the confirmation receipt from USCIS
2) I did not find any instructions come up for the list of supporting documents that need to be sent. Should I send the supporting documents (based on what I saw on this site) anyways?

I am EB2, Indian. Filed for PERM earlier this summer and waiting for approval which I don't expect for another 4-6 months. The situation is that my company is in a very shaky financial position but they have been very supportive and I am hoping to be okay for the next 6 mo to year. My strategy is (assuming I don't lose my job) to just sit out my I-140 approval and that way I get the 3-yr extension and lock in my PD. I don't see being able to file for I-485 at this job.
Soo -- 2 questions:
1) Do you think the financial position of the company will affect the I-140 approval? It's a financial services firm and we have had a bunch of layoffs.

For question 2: Answer Yes.

Since 7 years I was working on EAD and now I am thinking to convert into H1B , since I am planning to get separated from spouse.(my GC process is dependent on my spouse).
I was not on H1B before.
Q1: Once I get my H1B, will my EAD gets revoked or can I maintain both H1B as well as EAD?
